The Department of Justice (DOJ) approves the warrantless arrest of the teacher who offers P50 million on Facebook to kill President Duterte.

Warrantless Arrest

On Friday, the inquest prosecutor General Ben Malcontento approves the warrantless arrest of the Ronnel Mas, a 25-year-old public school teacher in Zambalez who was charged with inciting to sedition.

The charges might be filed next week in Zambales as Mas would spend more weekends in jail.

Based on the Article 125 of the Revised Penal Code imposes a deadline that should last for 12 hours, 18 hours or 36 hours depending on the offense.

Moreover, on Mas’ case the deadline has lapsed and he cannot post a bail until the charge is filed in court. He need not to wait for the inquest resolution before he can post bail, Malcontento said.

Based on the report of Rappler, Malconteto said, “That’s his call and the call of his defense team because from the start that is bailable.”

This was after he was asked for another way to post bail. Filing a petition for bail before a court, or a petition for the writ of habeas corpus, are the other possible way to post bail without being charged.

Mas was one of the arrested social media users after posting about killing President Duteter. Offering a huge amount ranging to P50 million to P100 million, which they did not have on hand, in exchange of Duterte’s life.
