Legal Basis of NTC to Shut Down ABS-CBN Kapamilya Network

The Shutdown of Kapamilya Network becomes the most trending topic online after the channel closed at 7:52 right after the flagship news program TV Patrol.

The netizens in the world of social media are searching the legal grounds as the valid reason for the National Telecommunications Commission (NTC) to close the giant network.

Recently, we learn that In March, NTC Commissioner Gamaliel Cordoba assured members of the House of Representatives that the agency would heed the advice of the Department of Justice to allow ABS-CBN to operate while its franchise renewal was pending in Congress.

However, Federation of International Cable TV and Telecommunications Association of the Philippines (FICTAP) President Neng Juliano-Tamano explained the legal reasons why ABS-CBN shutdown by the NTC.

According to Tamano, it was on the year 2014 they informed ABS-CBN that the renewal of franchise could not be granted in the ground of different name from the original franchise in 1995.

Tamano clarifies that they should have to follow rule of “one franchise one channel” which is the same with their original franchise reflected as “ABS-CBN Channel” but when they applied renewal in 2014 they made a change of the name adding letter “S” to the channel indicated to the franchise.

Tamano said, adding “S” to the name indicates multiple channels to operate which is a violation to the “one franchise once channel” policy.

Tamano added that they have advised the ABS-CBN to fix the problem since the time of Chairman Congressman Marcelino Teodoro. They are waiting for a long time since 2015, 2016, 2017, 2018 until 2019 but the same document they submitted without correcting the problem that causes disapproval of the franchise.

Tamano said that they believed that the change of adding “S” is an intention to justify to operate their “Mahiwagang Drop Box” and the TV Plus with six (6) additional channels without franchise.

Tamano explained that they are using the air wave of the ABS-CBN with multiple channels broadcasting and collect payment to the subscribers from which that is supposed to be free.

Tamano ntoed that they also collect during the fight of Manny Pacquiao vs Mayweather and Tamano said they inform the NTC about this and the NTC issued cease and desist order in the ground that their TV Plus was on trial. Despite of the NTC cease and desist order they still pursue the airing and collect 2,500 from the viewers. In addition, their Kapamilya Box Office (KBO), they also collected P30 from viewing the program which Tamano said a big violation against the law of making money from the program in which she said they’re using “free to air” broadcast.
