Solicitor General Jose Calida Asks SC to Forfeit ABS CBN’s Franchise

The Office of the Solicitor General files a quo warranto petition asking the Supreme Court to forfeit the legislative franchise of the ABS-CBN Kapamilya Network.

According to the report published by the Inquirer.Net, Solicitor General Jose Calida give his official statement about the case filed against ABS-CBN Network in order to stop the supposed “abusive practices.”

Calida said, the Office of the Solicitor General want to put an end to what they have discovered as he said, “highly abusive practices” of ABS-CBN benefiting a greedy few, at the expense of millions of its loyal subscribers.

Calida added that the said practices of the network have gone unnoticed or were disregarded for years, he said.

Calida explained that their petition will show the anomaly of the ABS-CBN network from hiding for a long time behind of what he said “elaborated crafted corporate veil.” Calida clarifies that there is a foreign investors taking part in the ownership of ABS-CBN which he said a violation of the foreign interest restriction of mass media under the 1987 Constitution.

According to the Article XVI, Section 11 of the Constitution, it says: “The ownership and management of mass media companies shall be limited to citizens of the Philippines, or to a corporations, cooperatives, of associations, wholly-owned and managed by citizens,” the Philippine Constitution said.

This simply means that in the Philippines only Filipinos are allowed to operate the mass media companies because they played integral role in a nation’s economic, political, and socio-cultural landscape,” explained Calida.

Calida added, that the said network has issued Philippine Deposit Receipts (PDRs) through ABS-CBN Holdings Corporation to foreigners, which act is a violation of the Constitution, Calida explained.
