BongBong Marcos Camp File Criminal Complaint Against Marlon Garcia of SmartMatic

Breaking News! The Camp of vice Presidential candidate Senator Ferdinand “Bongbong” Marcos Jr. has officially filed a criminal complaint against Marlon Garcia of Smartmatic for their “unauthorized” change in script of the Commission on Elections’ (COMELEC) transparency server.

According to the source, this developed as lawyer Jose Amor Amorado, Head of the BBM Quick Count Center, said they will request the poll body for additional access to other components of the Automated Election System in addition to a system audit of the transparency server and central server of the poll body.

The case was filed last Friday, May 20, 2016 at the COMELEC office. The Camp of the lawmaker from Ilocos Norte filed case allegedly violating the Automated Election System Law or Republic Act No. 9369. Under this law, acts that include “interfering with, impeding, absconding for purpose of gain, preventing the installation or use of computer counting devices and the processing, storage, generation and transmission of election results data or information” are prohibited.

Marcos was not among the complainants but lawyer Jonathan de la Cruz, campaign adviser of the vice presidential candidate and Abakada party-list, filed the 14-page complaint on his behalf.

“Ako lang ang nag-complain. Bilang isang mambabatas importante na maintindihan ‘yung paglabag ng isang batas para pagdating ng panahon, sa susunod po na eleksyon at may aumomated ulit makikita natin ang dapat pagbabago sa batas,” he told reporters after filing.

(I was the only one who filed the complaint. As a lawmaker, I need to understand the violations against a law so that when the time comes for the next automated elections we already know the changes we need to make in our laws.)

The camp of Marcos asked the COMELEC to allow their own information technology (IT) experts to check the network operating system of the transparency server, last May 12, 2016.
